Terms & Conditions

This Agreement is entered into by The Conscious Hypnotist (referred to as "I" or "Coach") and the Client (referred to as "you") to provide coaching and hypnotherapy services as outlined in Schedule A attached to this Agreement.

Description of Services

Coaching and hypnotherapy are distinct yet complementary processes aimed at facilitating personal, professional, and emotional growth. Coaching focuses on maximising your potential, setting and achieving goals, and overcoming limiting beliefs. Hypnotherapy uses relaxation techniques and focused mental states to bring about positive subconscious change. Together, these services provide a holistic approach to healing and personal transformation.

Coach-Client Relationship

A. Ethics and Standards
The Conscious Hypnotist agrees to maintain the ethics and standards of behaviour established by the International Coach Federation (ICF) and in accordance with the American Hypnotherapy Board's guidelines for professional hypnotherapy practice.

B. Client Responsibility
The Client is solely responsible for their physical, mental, and emotional well-being, decisions, actions, and results arising from both coaching and hypnotherapy sessions. The Coach will not be liable for any actions, inactions, or lack of results stemming from these services.

C. Coaching and Hypnotherapy Disclaimer
The Client understands that coaching and hypnotherapy are not substitutes for medical or mental health care. Hypnotherapy does not prevent, cure, or treat mental health disorders, and coaching does not replace therapy. It is the Client’s responsibility to seek professional medical or mental health support if necessary. If the Client is currently under the care of a medical or mental health professional, they must disclose this and provide written consent before proceeding with coaching and/or hypnotherapy.

D. Termination of Services
The Client may choose to terminate or discontinue the coaching and/or hypnotherapy relationship at any time, subject to the terms of payment outlined in this Agreement.

E. Comprehensive Approach
Coaching and hypnotherapy may involve various aspects of the Client’s life, including work, relationships, health, and personal development. The Client agrees to take responsibility for implementing the guidance provided and making decisions based on their unique circumstances.

F. No Diagnosis or Treatment
Coaching and hypnotherapy are not intended for diagnosing or treating mental health disorders. If the Client is under the care of a medical professional, they must inform the Coach and obtain written consent from their medical provider prior to commencing services. The Coach may refuse to provide services if this consent is not obtained.

G. Communication and Participation
The Client agrees to communicate openly, be receptive to feedback, and engage fully in the coaching and hypnotherapy processes.

Services

A. The parties agree to engage in the coaching and/or hypnotherapy services detailed in Schedule A. The Coach will be available for additional support via email or other communication channels as agreed.

B. The Coach may be available for additional time or services outside of the agreed-upon sessions at an hourly or project rate, confirmed prior to delivery.

Schedule and Fees

A. Coaching and Hypnotherapy Fees
The Client agrees to pay for the coaching and hypnotherapy services as outlined in Schedule A. This includes coaching sessions, hypnotherapy sessions, emails, calls, and any additional services provided.

B. Session Duration
Each session’s length will be as specified in Schedule A.

C. Changes to Rates
If rates change before this Agreement is signed, the prevailing rates will apply.

D. Non-Refundable Fees
All fees paid for coaching and/or hypnotherapy services are non-refundable, regardless of whether the Client decides to discontinue the services before completion.

E. Refund Policy
The refund policy, if applicable, is detailed in Schedule A.

Procedure

A. The timing and location of coaching and/or hypnotherapy sessions will be mutually agreed upon by the Coach and Client. If sessions are held via phone or online, the Client will initiate the calls as scheduled.

Confidentiality

A. All communications between The Conscious Hypnotist and the Client are confidential, in line with the ICF Code of Ethics and the American Hypnotherapy Board's confidentiality standards. However, it is important to note that the Coach-Client relationship is not legally privileged in the same way as the medical and legal professions, and communications are not subject to legal confidentiality protections.

B. Exceptions to Confidentiality
Confidential information may be disclosed in the following situations:
a) The information was already in the Coach’s possession before it was shared by the Client.
b) The information is publicly available or generally known in the Client’s industry.
c) The Coach receives the information from a third party without breach of confidentiality.
d) The Coach independently develops the information.
e) The Coach is required by law, subpoena, or court order to disclose the information.
f) There is an imminent risk of harm to the Client or others, in which case disclosure may be necessary.
g) The information involves illegal activity.

The Client has an ongoing responsibility to raise any concerns about confidentiality promptly.
